Body work factory defect

I noticed the other day when I got my spoiler and test fitted it that the body work was not aligned properly the rear cover seem to fit about an 1/8th of an inch or more above the body line on the passenger side. I followed that line and found swirl marks in the paint from where they sanded down a section then did a poor job of cleaning it up.

The car has never been in a wreck or had any damage so the only thing I can think is that the factory did a poor job on the rear cover. Looks like a cheap messican paint job and it is below the clear coat where you can see the swirl marks in little circles all down the cover. This is also where the cover sits up about 1/8th of an inch. So I wonder if it was damaged at the factory and they did a quick clean up job?

The car is at the dealer now getting that recall fixed and I had them look at that issue at the same time.

Looks like an on the spot fix for slight shift/damage during delivery and/or unloading of the truck. They should be obligated to fix it for sure

Yes the dealer fixed the problem it looks great now and my spoiler actually sits flat. I will be mounting it soon. I don't want to drill holes in the top so I am thinking of using 3M double sided tape.
