It doesn't matter if it's "registered" or not. If it's being used as a trademark, it can be defended as such. Registration significantly bolsters the defense, but is not required to make the claim. Also, just because it's registered doesn't provide 100% protection. Time of first use and showing it has indeed been used as a trademark is an important factor. There are gray areas where two (or more) parties may have a claim. That's when you have a "buy out" or go to court.

In our case, it's better to find something that is not used anywhere else (as best we can determine....google searches help!). Then "TM" it (you can do that for free!). Could register it too....but that costs a token or two.
